We are LOOPRIDE INC., doing business as Loop Rideshare and Loop Rides (“Company,” “we,” “us,""our”), a company registered in Canada at 2000, Argentia road, Plaza 3, Suit 400, Missisauga, ON, L5N 1V9 Ontario. We operate the website www.looprideshare.com (the “Site”), the mobile application Loop Rideshare (the “App”), as well as any other related products and services that refer or link to these legal terms (the “Legal Terms”)(collectively, the “Services”). These Legal Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”), and LOOPRIDE INC., concerning your access to and use of the Services. You agree that by accessing the Services, you have read, understood, and agreed to be bound by all of these Legal Terms. IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USEIMMEDIATELY. Supplemental terms and conditions or documents that may be posted on the Services from time-to-time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Legal Terms at any time and for any reason. We will alert you about any changes by updating the “Last updated” date of these Legal Terms, and you waive any right to receive specific notice of each such change. It is your responsibility to periodically review these Legal Terms to stay informed of updates. You will be subject to and will be deemed to have been made aware of and to have accepted, the changes in any revised Legal Terms by your continued use of the Services after the date such revised Legal Terms are posted.

The Services are intended for users who are at least 18 years old. Persons under the age of 18 are not permitted to use or register for the Services. We recommend that you print a copy of these Legal Terms for your records.

“AS IS” and “AS AVAILABLE” Disclaimer

The Service is provided to You “AS IS” and “AS AVAILABLE” and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, the Company, on its own behalf and on behalf of its Affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the Service, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice. Without limitation to the foregoing, the Company provides no warranty or undertaking, and makes no representation of any kind that the Service will meet Your requirements, achieve any intended results, be compatible or work with any other software, applications, systems or services, operate without interruption, meet any performance or reliability standards or be error free or that any errors or defects can or will be corrected.

Without limiting the foregoing, neither the Company nor any of the company’s provider makes any representation or warranty of any kind, express or implied: (i) as to the operation or availability of the Service, or the information, content, and materials or products included thereon; (ii) that the Service will be uninterrupted or error-free; (iii) as to the accuracy, reliability, or currency of any information or content provided through the Service; or (iv) that the Service, its servers, the content, or e-mails sent from or on behalf of the Company are free of viruses, scripts, trojan horses, worms, malware, timebombs or other harmful components.

Some jurisdictions do not allow the exclusion of certain types of warranties or limitations on applicable statutory rights of a consumer, so some or all of the above exclusions and limitations may not apply to You. But in such a case the exclusions and limitations set forth in this section shall be applied to the greatest extent enforceable under applicable law.

SEVERABILITY

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

LIMITATION OF LIABILITY:

To the fullest extent permitted by the applicable laws, under no circumstances shall [Your Ridesharing Company’s Name] (“the Company”) or its suppliers be held liable for any exceptional, incidental, indirect, or consequential damages whatsoever. These damages encompass, but are not restricted to, the following: loss of profits, loss of data or other crucial information, disruption of business operations, personal injury, or infringement upon personal privacy. These potential damages are associated with, or in any way connected to, the utilization of our services, the inability to utilize our services, the application of third-party software or hardware alongside our services, or any other facet of these terms.

Even if the Company or any driver operating through the platform has been duly advised of the potential for such damages, and irrespective of whether the attempted remedy falls short of its fundamental purpose, no liability shall be borne by the Company.

1. OUR SERVICES

The information provided when using the Services is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country. Accordingly, those persons who choose to access the Services from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable. Loop rideshare provides, by way of the Platform for posting, listing, requesting, searching for, discovering, inquiring about, marketing, scheduling, and arranging for Rides by and among Drivers and Riders. The Platform is a set of online and mobile tools that match Riders with Drivers (and, in certain cases, pre-arranged locations for Loop Rideshare) to facilitate the delivery and servicing of Rides by Drivers. The Loop rideshare may also be used, now or in the future, to facilitate the provision by Drivers of other Driver Services, such as delivery or transportation of products, goods, or other items.

2. Description of Service

Loopride provides a platform that connects individuals seeking rides (“Riders”) with individuals offering rides (“Drivers”). Our Services include facilitating the arrangement, scheduling, and payment processing for these rides. Loop’s platform also allows for the posting, listing, and discovering of rides, as well as communication between Riders and Drivers. Loop may expand its platform’s offerings to encompass additional services beyond ridesharing in the future.

In the capacity of a Rider within the LoopRide platform, you extend your authorization to Loopride for the purpose of pairing you with a suitable Driver. Conversely, as a Driver, you grant Loopride the authority to align you with one or more Riders. This matching process hinges upon various critical factors, including but not limited to your geographical location, estimated pickup time, intended destination, user preferences, and the overall efficacy of the platform. Within this framework of authorization, you also empower Loopride with the prerogative to execute cancellations of scheduled Rides. Subsequently, Loopride reserves the right to reassign you with alternative Riders or Drivers as necessitated by similar or distinct considerations and factors. It’s noteworthy that both Riders and Drivers further authorize Loopride to orchestrate the pairing of a single Driver with multiple Riders for a given proposed Ride. Moreover, the Company retains the latitude to adjust or reorganize the composition of Riders and Drivers for any given Ride at any juncture prior to the commencement of said Ride.

Importantly, it is imperative to recognize that the Driver Services and Rides tendered and conducted through the Platform do not constitute offers presented by Loopride for services, nor do they form integral components of the overarching Loopride. Riders, in their sole discretion, leverage the Platform’s capabilities to explore, organize, and provide consent for various Driver Services. Loopride remains uninvolved and extraneous to any determination undertaken by a Rider to embrace a Ride or any other Driver Services made accessible through the Platform. Loopride also explicitly disclaims responsibility for any facets associated with a Rider’s choice to accept and engage with Driver Services.

3. USE OF THE PLATFORM

3.1 Eligibility

Loop ride offers a Carpool service which allows Members to contact each other to arrange a Carpool. The Passenger is expected to contact the Driver through the Service to arrange a Carpool and any conditions of travel (including size of luggage, equipment, etc).

The eligibility of a member to use the Carpool service is to Loop ride’s discretion and as such loop ride reserves the right to withdraw that service from any Member at any time. Before any user can offer and provide Rides and Driver Services as a Driver using our Platform, we review the application of Driver Applicants and, if accepted to be a Driver, we review certain Driver credentials. Our review of Driver’s credentials consists of a review and inspection of the driver’s license, applicable insurance coverage, and vehicle registration . However, we are limited in our capacity, and in some cases, we may not be able, to confirm that the credentials presented to us by the Driver Applicant are genuine and authentic. While we believe that our review of Driver credentials are part of our process helps to keep our Platform safe, there can be no assurance that, and we make no representations or warranties whatsoever that, our process will keep you safe if you participate in any Rides or procure any Driver Services through our Platform.

3.2 User Account

To access specific features and functionalities offered by the Loop Rideshare Platform, including but not limited to providing, listing, requesting, posting, marketing, purchasing, or arranging for Rides or Driver Services as a Rider or Driver, the establishment of a user account is a prerequisite. Unauthorized usage of another user’s account is strictly prohibited. During the account creation process, it is imperative to provide accurate and comprehensive information, and to ensure that such information always remains accurate and complete. Any necessary modifications, corrections, or deletions of account information can be made directly by accessing your account and effecting the desired changes.

The responsibility for maintaining the security of your account and its corresponding password rests solely with you. Timely notification to Loop Rideshare is essential in the event of any security breach or unauthorized use of your account. While Loop Rideshare assumes no liability for losses resulting from unauthorized account usage, you acknowledge potential liability for losses incurred by Loop Rideshare or others due to such unauthorized activities.

You agree not to establish an account on behalf of any individual, group, or entity without proper authorization to do so. By registering another individual, group, or entity, you assert your authorization to undertake such action. The practice of creating multiple Loop Rideshare accounts for any purpose, including taking advantage of promotions and credits, is explicitly prohibited. Riders or Drivers found with multiple accounts may face the potential revocation of their membership, either temporarily or permanently, at the sole discretion of Loop Rideshare.

3.3 User Conduct

3.3.1 Drivers:

As a Driver Member participating in LoopRide’s esteemed platform, it is crucial to be aware of the Responsibilities, the adherence to which is of utmost importance. Violation of these responsibilities may lead to repercussions, including temporary suspension of your account or the permanent closure of your account.

In your capacity as a driver within our service, you hereby agree to the following obligations:

  1. Accurate Information and Clear Designation:

    • Provide accurate and truthful information when creating ride postings.
    • Designate clear and explicit meeting places for your passengers.
  2. Compliance with Ride Indications:

    • Adhere to the information and instructions you have included within the ride postings.
  3. Timely Arrival and Notification:

    • Arrive at the designated meeting place a minimum of 5 minutes before the stipulated departure time mentioned in your ride posting.
    • In case of any cancellations or modifications, promptly inform LoopRides at least 24 hours before the scheduled departure time. Last-minute cancellations may lead to account suspension or membership revocation.
  4. Patient Waiting and Passenger Notification:

    • Exercise patience by waiting for at least 10 minutes at the meeting place if a passenger is missing.
    • Notify Loopride about any absent passengers.
  5. Passenger Verification and Safety:

    • Ensure the identity verification of your passengers.
    • Confirm that passengers onboard match the individuals who have reserved seats.
  6. Safe and Timely Drop-off:

    • Safely and punctually transport passengers to their agreed-upon destination.
  7. Adherence to Traffic Regulations:

    • Abide by the Highway Safety Code applicable to the jurisdiction(s) through which you are traveling.
  8. Vehicle Maintenance and Condition:

    • Maintain your vehicle in optimal working condition and inspect its state prior to each ride.
  9. Adequate Car Insurance:

    • Possess car insurance coverage that extends to passenger transportation.
  10. Legal Compliance:

    • Observe the driving, carpooling, and ridesharing regulations specific to your province, state, and country.
  11. Passenger Seating Limitation:

    • Limit the rear seating to at most two passengers (for standard five-seat vehicles), even if the vehicle’s maximum capacity allows for more.
  12. Respectful Behavior and Reporting:

    • Treat all individuals with respect and promptly report any instances of harmful or disrespectful conduct, as well as violations of the Rules of Conduct by passengers.
  13. Cancellation with no explanation or No Show:

    • Our platform will refund the charges procured to the customer while exercising strict consequences against the driver as per the case resolution team deems fit.
  14. Personal Posting Restriction:

    • Refrain from posting rides using your Loopride account on behalf of anyone other than yourself.
  15. Reporting Violations and Fine Authority:

    • Alert Loopride administrators when another user breaches the Terms of Service. In such cases, only administrators can levy fines on the erring users.
  16. Cost Coverage Compliance:

    • Ensure that the aggregate contribution sought from each passenger, multiplied by the total occupants in the vehicle (including yourself), does not surpass the necessary amount to cover the standard operational expenses of your vehicle.
    • Note: This adherence preserves the legality of your service usage within the definition of carpooling, in accordance with appropriate guidelines in the operating province or provinces.

In alignment with these comprehensive responsibilities, LoopRide aims to foster a secure, ethical, and harmonious environment for its Driver Members, contributing to the overall well-being of the LoopRide community and its shared objectives.

3.3.2 RIDERS

As a respected Member engaging with LoopRide’s distinguished platform, it is paramount to acknowledge the Responsibilities, as adherence to these obligations holds utmost significance. A breach of these responsibilities may lead to consequences, such as temporary suspension of your account or the permanent termination of your account. In your role as a Rider within our service, you hereby concur to the following stipulated responsibilities:

  1. Timely Arrival and Departure:

    • Arrive at the predetermined meeting place a minimum of 5 minutes before the specified departure time indicated in the ride posting.
  2. Compliance with Driver Preferences:

    • Familiarize yourself with and adhere to the preferences and requirements of your driver, encompassing aspects such as second-hand smoke, luggage size, acceptance of pets, and all other specifications stated in the ride posting.
  3. Cancellation Notice:

    • Provide Loopride with notice of any cancellations at least 24 12 hours before the scheduled departure time of the ride. Last-minute cancellations may result in account suspension or membership privileges being revoked.
  4. Patient Waiting and Driver Notification:

    • Exercise patience by waiting for at least 15 minutes at the meeting place if your designated driver is absent.
    • Promptly inform Loopride about any instances of your driver’s absence.
    • Also, promptly inform Loopride in any condition or circumstances where the driver has completely disregarded the promise of a ride provided through the booking agreement. Our platform will refund the charges procured to the customer while exercising strict consequences against the driver as per the case resolution team deems fit.
  5. Driver and Vehicle Verification:

    • Before entering a vehicle posing as the driver for the requested ride, it is the responsibility of the rider to confirm the vehicle details conveyed through the ride information page as well as confirming each other’s identity.
    • Verify that the driver’s name, as well as the details of the car model, color, and license plate number, correspond to the information conveyed to you by Loopride if provided on the ride information screen.
  6. Adherence to Traffic Regulations:

    • Not allowed to coerce the driver to perform any action that does not abide by the stipulated provisions of the Highway Safety Code applicable to your travel jurisdiction.
  7. Legal Compliance:

    • Follow the legal requirements pertinent to carpooling as outlined by the laws of your province, state, and country.
  8. Respectful Conduct and Reporting:

    • Display respect toward fellow passengers and promptly notify Loopride of any instances of harmful or discourteous behavior, or any violations of the Rules of Conduct exhibited by other passengers or your ongoing ride’s driver.
  9. Personal Booking Restrictions:

    • Refrain from reserving seats through your account for individuals other than yourself, unless the said individuals are traveling alongside you in the same vehicle for the same ride.
    • The platform currently only supports providing ability for a single person to book a specific ride accommodating one seat.
  10. Reported Infractions to Administrators:

    • Alert Loopride administrators in case another user breaches the Terms of Service. In such scenarios, administrators possess the authority to apply finesapply restrictions to the responsible users.

By embracing these comprehensive responsibilities, LoopRide aims to cultivate a secure, respectful, and collaborative atmosphere for its Riders. This commitment contributes to the overarching welfare of the LoopRide community, ensuring the fulfillment of shared goals and objectives.

4. REGISTRATION OBLIGATION

As a valued participant in the Loop Rideshare platform, it is imperative to establish an Account to access the Service. To successfully create an Account, you are required to:

  1. Provide Essential Profile Details:

    • Your legal first and last names.
    • Provide a well-lit profile image portraying your face distinctly.
    • Offer a truthful self-description.
    • Disclose your age and gender.
  2. Agree to Terms and Policies:

    • Consent to our prevailing Terms of Service and Privacy Policy.
    • You automatically agree to our terms of service and privacy policies when you press the continue button to begin verification process on Loop mobile application or as soon as you start using any of the services provided Loop Rides platform.

By initiating the Account creation process, you acknowledge your commitment to providing information that is accurate and authentic, pledging to keep it up-to-date either through your profile or by notifying Loop Rideshare.

By adhering to these guidelines, you contribute to the establishment of a secure, transparent, and accountable community within the Loop Rideshare platform. Your dedication to these principles is instrumental in fostering a harmonious and trustworthy environment for all Members.

5. CANCELLATION POLICY

5.1 Driver Cancellation:

As a Driver on Loopride, you have the authority to cancel a Trip that lacks confirmed Passengers at any time without incurring any penalties.

However, you can cancel either one Trip with approved Booking(s) or one approved Booking within a month period. If a second cancellation occurs within this month period, your Account will undergo a review process, and it may potentially be blocked.

When you cancel a Trip (with approved Booking(s)) or an approved Booking, the following steps will be taken:

  • Passengers will receive a full refund, including 100% of the Trip Contribution and the Booking fee.
  • Your profile will receive the cancellation flag.
  • Loopride will assess the situation to determine if the Cancellation is due to your the driver’s fault or any nature of events outside of the control of the individual, and whether it affects your cancellation flag.
  • If you are found at fault, the cancellation will count towards your cancellation flag.
  • If you are not at fault, the cancellation will not count against your cancellation flag will be removed from your record.
  • The driver is able to put in a request for a removal of any cancellation flag by providing a detailed explanation of the situation and any relevant information regarding the situation via email on our email info@looprideshare.com. Our dedicated resolutions team will review and respond within a timely manner by emailing back on the provided email address.
  • Please be aware that Loopride reserves the right to suspend your Account if your actions are negatively impacting other members’ experiences.

5.2 Driver No-Show Policy:

Not showing up for a Trip with confirmed Passengers is a serious matter and could lead to immediate Account termination.

  • If a Passenger reports a no-show incident involving you during a Trip, Loopride will investigate further
  • If the no-show cannot be verified or if it was a mistake, there will be no penalty for you.
  • If the no-show is verified and you are not at fault, a no-show review will be added to your profile, and your Account will remain open.
  • If the no-show is verified and you are at fault, a no-show review will be added to your profile, and your Account may be blocked.
  • Please remember that Loopride can suspend your Account if your actions are negatively impacting other members’ experiences.

5.3 Rider Cancellation Policy:

As a passenger, who has a confirmed booking, and decides to cancel the ride at any moment, following are the regulations in place to keep our platform to serve better:

  • If a Rider cancels a Booking more than 24 12 hours before the Trip’s scheduled departure time, they will receive a refund for the full Trip Contribution. However, Loopride will retain the Booking fee.
  • If a Rider cancels less than 24 12 hours before the Trip’s scheduled departure time, you, as the Driver, will receive 50% of the Contribution amount. The remaining 50% will be refunded to the Rider, while the Booking fee is retained by Loopride.
  • If a Rider cancels after the Trip’s scheduled departure time or fails to show up within 10 minutes10 minutes of the departure time, you, as the Driver, will receive 100% of the Contribution amount. Loopride will retain the Booking fee, and no refund will be issued to the Rider.
  • When a Rider cancels, the freed seats in the Trip are offered to other Loopride members, subject to the policies outlined in this document.
  • If you cancel a Trip after a Rider cancels a Booking, a full refund, including the Booking fee, will be issued to the Rider.

5.4 Request to Book Process:

  • Passengers can withdraw a Booking request before approval without any charges.
  • If a Booking request expires, there are no charges incurred by the Passenger.
  • In both cases, the Booking fee is not applicable, and a full refund is provided.
  • Loopride reserves the right to issue refunds to Passengers outside the standard cancellation policy in certain circumstances, when a Driver offers an unauthorized commercial service, when a Passenger makes a booking mistake and requests a refund promptly.
  • Consistent cancellation of Bookings by a Passenger may lead to the closure of their Account.

5.5 Passenger No-Show Policy:

If a Passenger who had booked a Trip fails to show up, Loopride’s Passenger no-show policy comes into effect:

  • You, as the Driver, will receive the entire Passenger Payment, and Loopride will retain the Booking fee.
  • A no-show review will be added to the Passenger’s profile.
  • Loopride retains the right to potentially suspend a Passenger’s Account if their actions are negatively impacting other members’ experiences.

5.6 Disputing Cancellations, Bookings, or Payments:

If you are a Driver or Passenger, you have four (4) days after the scheduled Trip departure to dispute a Booking, Cancellation, or Payment that affects a Payout to the Driver. If there are no disputes within this timeframe or if a Passenger indicates that the Trip was successfully completed through Loopride’s Service or other communication channels, the Payment to the Driver will proceed as usual, following the rules stated in this section.

To dispute a Booking within this four-day window, email us at info@looprideshare.com. After the four-day window, refunds for contested scenarios related to Bookings, Cancellations, or Payments will not be processed.

6. INDEMNITY AND LIMITS

You understand and accept that Loop Rideshare does not conduct background checks on its users, and it cannot be held responsible for the behavior, personal conduct, or any criminal activities of its members before, during, or after using the service. Furthermore, Loop Rideshare does not validate the accuracy of the information provided by its members. It is your responsibility to ensure your own safety and protection while interacting and communicating with other community members. Loop Rideshare is not liable for any direct or indirect losses, damages, personal injuries (physical or psychological), or material harm incurred by you, other members, or third parties as a result of using the service, relying on information from the platform, the misuse of the service by other members, or any information obtained through Loop Rideshare.

You agree to indemnify and hold Loop Rideshare, its subsidiaries, affiliates, officers, employees, agents, co-branders, partners, and licensors harmless from any claims or demands, including reasonable legal fees, brought forth by any third party. These claims or demands may arise due to or in connection with the content you submit, post, transmit, or make available through the service, your utilization of the service, your connection to the service, your violation of the Terms of Service (TOS), or your infringement upon the rights of another individual or entity.

7. INSURANCE

As a responsible user of Loop Rideshare, both Drivers and Passengers must adhere to the following guidelines:

  • Driver’s Responsibility: Drivers must ensure that their vehicle is adequately insured in compliance with the prevailing laws. It is their duty to verify the validity of their insurance coverage before every Trip. Additionally, possessing a valid Driver’s license is mandatory for all Drivers.
  • Insurance Verification: Drivers and Riders should independently consult their insurance providers to confirm their coverage while engaging in carpooling activities. It is important to ascertain whether insurance policies extend to carpooling situations.
  • Company-Issued Vehicles: For Drivers using company-issued vehicles, it is their responsibility to ascertain that their insurance policies provide coverage for all Riders during carpooling journeys.
  • Insurance Exclusions: Both Drivers and Riders should be aware that insurance companies might refuse coverage for damages incurred during carpooling using a private vehicle for commercial purposes.
  • Financial Responsibility: In the event of an accident leading to uncovered insurance claims, the Member assumes full financial responsibility. It is important to understand that Loopride bears no liability in such circumstances.
  • Account Suspension and Legal Implications: Loopride retains the right to suspend a Member’s Account and withhold any outstanding Payments if there is suspicion or confirmation of the Member engaging in commercial activities related to the Service. Moreover, Loopride reserves the right to report any illegal activities conducted through the Service to the appropriate authorities.

8. DISCLAIMER OF WARRANTIES, LIABILITIES, REPRESENTATIONS AND CONDITIONS

As an essential part of Loop Rideshare, it is crucial to comprehend the following aspects:

8.1 Company’s Role:

Loop Rideshare does not partake in any aspect of the Ride itself or the execution of any Ride. The Company does not endorse or vouch for any Driver utilizing the Platform to offer, schedule, or arrange Rides. It’s important to note that Drivers and their services operate independently of the Company. The Platform merely facilitates the connection between Riders and Drivers. The Company is not involved in the employment or hiring of Drivers for rendering services.

8.2 Disputes and Conduct:

Loop Rideshare is not accountable for any conflicts, claims, losses, injuries, or damages arising from the actions of Drivers, Riders, or other users during the use of the Platform or in relation to any Ride or Driver Services. The Company does not guarantee or oversee the quality, experience, or conduct of any Ride. Furthermore, the Company is not liable for any delay or failure in a Ride due to the inability of a party to meet the designated location and time.

8.3 Ride Information and Representation:

Loop Rideshare is not accountable for any information provided by Drivers or Riders. This includes any representations made by Drivers regarding Ride quality, vehicle condition, or other matters. The Company does not endorse, warrant, or guarantee the accuracy, suitability, quality, or other attributes of any information provided by users on the Platform.

8.4 Assumption of Risk:

By using Loop Rideshare to arrange Rides and Driver Services, Riders acknowledge and embrace the inherent risks associated with the Platform. Loop Rideshare cannot ensure protection from all potential risks involved with independent Drivers, and users bear responsibility for their safety during Rides. While efforts are made to ensure safety, the Company cannot guarantee complete risk mitigation.

8.5 Goods Transportation and Responsibility:

8.6 Platform Usage and Limitations:

Loop Rideshare is offered on an “as is” basis, and no warranties or conditions, either explicit or implied, are provided. The Company does not assure specific outcomes from Platform usage. The Company is not accountable for any inaccuracies, disruptions, unavailability, or errors in the Platform. Loop Rideshare does not guarantee the identity of users and cannot be held liable for interactions between users.

8.7 User Safety and Reporting:

Users are advised to communicate directly with potential Drivers or Riders before engaging in Rides. Users should exercise caution when interacting with individuals on the Platform. Loop Rideshare encourages users to report any suspicious situations to customer service for further guidance and resolution.

We are committed to providing a positive and inclusive experience for all users, including those with specific needs or disabilities. If you require accommodations or have special requests due to your specific needs, we encourage you to directly communicate with the driver. This will the driver to better understand and fulfill your requirements to the best of their abilities, ensuring a safe and comfortable experience for everyone. Your cooperation and open communication are essential in helping us serve you effectively.

8.9 User Responsibility and Account Security:

Users are responsible for their user accounts and should promptly report any unauthorized account activity. Loop Rideshare is not liable for unauthorized use of accounts. The accuracy of location data provided by the Platform cannot be fully relied upon for critical situations.

8.10 Data Usage:

It is recommended to use the Platform with an unlimited or high data usage plan. Loop Rideshare is not responsible for data-related charges associated with accessing the Platform.

9. FEES AND CHARGES

9.1 Rider Fees

When you, as a Rider, utilize Loop Rideshare to procure Rides and Driver Services, you will incur fees (“Fees”). These Fees are payable through the Platform, which may utilize Third-Party Applications for payment processing. The Fees encompass various elements, such as base fees for Rides, additional toll charges, and in some cases, supplementary fees based on factors like scheduled time, location, vehicle type, or other relevant criteria. It is your responsibility to review the Fees applicable to your Ride before confirming the order. After purchase, you are accountable for paying the Fees associated with the services ordered.

9.2 Service Charge

Certain Driver categories are subject to a “Service Charge,” which is a percentage of the total Fees collected from Riders. This charge varies depending on factors like Ride length and more. The Company reserves the right to alter the Service Charge without prior notice. While Third-Party Applications process Fee payments, the Company does not levy additional payment processing fees aside from the Service Charge. However, the Company retains the right to modify this policy at any time.

9.3 Damage Fee

In cases where a Driver reports significant damage or soiling to their vehicle caused by a Rider, the Rider agrees to pay a “Damage Fee.” This fee covers reasonable costs for restoring the vehicle to its prior condition, as determined by Loop Rideshare. The Company reserves the right to request documentation of damages before processing the Damage Fee.

9.4 Additional Fee Terms

Paying Fees through Loop Rideshare fulfills your payment obligation. Riders might receive coupons, discount codes, or incentives applicable to specific Fees. To order Rides or Driver Services, Riders must have valid payment method information on file. Unless specifically sanctioned by Loopride or advertisers, you commit not to alter, lease, loan, sell, disseminate, or construct derivative works grounded on the Service or the Software, either wholly or partially.
